By purchasing from or working with Tamega Flower Farm (“we,” “us,” or “our”), you agree to the following Terms & Conditions. These terms apply to all customers, including retail flower bar customers, boutiques, and wholesale florist accounts.

1. Products & Seasonal Availability

We are a Texas-based flower farm specializing in seasonal, locally grown flowers. All products are subject to availability based on growing conditions, weather, and seasonal cycles common to Texas agriculture.

Because flowers are natural, perishable products, variations in color, size, stem length, and bloom stage are normal and not considered defects. We reserve the right to substitute flower varieties with similar colors or styles when necessary.

2. Retail & Flower Bar Sales

  • Flower bar purchases are sold as-is at the time of sale.

  • Customers are responsible for proper handling and care once flowers leave our premises.

  • All retail and flower bar sales are final unless flowers are clearly damaged or unusable at the time of purchase.

We may provide care instructions; however, flower longevity is influenced by environmental conditions and cannot be guaranteed.

3. Wholesale Accounts (Florists & Boutiques)

Wholesale pricing is available to approved florists and retail businesses.

Wholesale Terms Include:

  • Minimum order quantities may apply.

  • Orders must be placed by the designated cutoff time to ensure availability.

  • Payment terms (prepayment, net terms, or invoicing) will be agreed upon in advance.

  • Late payments may result in delayed orders or suspension of wholesale privileges.

We reserve the right to modify wholesale pricing, minimums, and availability at any time.

4. Orders, Payments & Cancellations

  • Payment is due according to the agreed terms at the time of ordering.

  • Cancellations must be made within the stated cancellation window.

  • Due to the nature of farming, harvesting, and advance planning, late cancellations may not be eligible for refunds.

5. Refunds & Replacements

Due to the perishable nature of flowers:

  • Refunds are not guaranteed.

  • Any issues with quality must be reported within 24 hours of pickup or delivery, along with photo documentation.

  • Approved claims may result in a replacement, partial refund, or store credit at our discretion.

6. Pickups & Deliveries

  • Customers are responsible for timely pickup unless delivery has been arranged.

  • We are not responsible for flowers once they have been picked up.

  • Delivery times are estimates and may vary due to weather, traffic, or other unforeseen circumstances common in Texas.

7. Weather, Agriculture & Force Majeure

As a working Texas flower farm, our operations are affected by weather events including heat, drought, freezes, storms, and other conditions beyond our control.

We are not liable for delays, shortages, or losses caused by weather, natural disasters, or other agricultural risks (“force majeure” events).

8. Sales Tax

Applicable Texas sales tax will be charged in accordance with state and local laws unless a valid resale or tax exemption certificate is provided prior to purchase.

9. Photography & Marketing

Unless otherwise requested in writing, we reserve the right to use photos of our flowers, displays, and arrangements for marketing, social media, and promotional purposes.

10. Limitation of Liability

To the fullest extent permitted by Texas law, [Your Flower Farm Name] shall not be liable for indirect, incidental, or consequential damages arising from the use or purchase of our products.

11. Governing Law

These Terms & Conditions are governed by and interpreted in accordance with the laws of the State of Texas, without regard to conflict of law principles.

12. Changes to Terms

We reserve the right to update these Terms & Conditions at any time. Continued purchases or business relationships indicate acceptance of the current terms.
